  • NSA against Varun Gandhi annulled

2009-05-14 11:46:48 - Supreme Court asked Uttar Pradesh govt to withdraw forthwith charges under the National Security Act against BJP leader Varun Gandhi which were imposed for his alleged hate speeches.

"The State government shall forthwith withdraw the detention order against Varun Gandhi under the NSA," a bench
headed by Chief Justice K G Balakrishnan said on Thursday.Supreme court disposed of the petition filed by Varun challenging the imposition of the NSA as well as the application filed by the Uttar Pradesh government seeking setting aside the decision of the State
Advisory Board recommending revocation of the stringent law against him.

Bench, comprising Justices P Sathsavim and Deepak Verma passed the order, the BJP leader's counsel and senior advocate Mukul Rohtagi did not press for the second petition seeking an exemplary damages of Rs 10 lakh from the Uttar Pradesh government. The bench was also critical of the UP Government approaching it with an application against the decision of the State Advisory Board which had not found sufficient ground for invocation of NSA against the 29-year-old BJP leader.

The apex court took exception to the submission made by the state government that the District Magistrate (DM) of Pilibhit could not be heard and only the Additional District Magistrate (ADM) was present before the Advisory Board during the hearing."This cannot be a ground to challenge the decision of the Advisory Board. The ADM was present. He must have been instructed by the DM," the bench observed. The court asked why the authority (DM) was not present.

Varun's counsel said that the provisions of the law clearly said that the case will be revoked upon the recommendation of the Advisory Board. He said that "some game" was going on and the state government has violated the law.The three-member U.P Advisory Board (Detentions) headed by senior judge of the Lucknow bench of Allahabad High Court Justice Pradeep Kant had on 8th May told the state government that “there is no sufficient ground to detain Varun under NSA and directed revocation of detention order of 29th March”.Welcoming the Supreme Court's order, Varun's aunt Ambika Shukla accused the state government of being vindictive and acting for petty political gains.

"We welcome the Supreme Court decision. The advisory board has actually given this decision on the 8th of this month earlier at which point, it became incumbent (on) for the State government to withdraw the NSA order forthwith.

"Unfortunately, due to petty political considerations, it did not follow the law and instead chose to file the application in the Supreme Court. The Supreme Court has found the application non-tenable and dismissed the NSA order forthwith," she told a news channel. However, the order of the apex court has come as a relief for the family members, she said."Better late than never. We welcome the order and are greatly relieved," Shukla added.

  • Bofors payoff flickers

Ottavio Quattrocchi, the surviving suspect in the Bofors payoff case has been dropped from the Interpol's wanted list at the behest of CBI, kicking a political storm with opposition parties accusing the govt of giving him a clean chit three weeks before it bows out of office.Ram Jhetmalalni said Congress wanted Italian Qttavio Quattrochi to be relieved from the Red corner in the last days of UPA as they have intution of not coming to power.

As the Government tried to put up a brave front, BJP's Prime Ministerial candidate L K Advani held Prime Minister Manmohan Singh and Congress President "guilty" for the CBI decision and said the party will reopen all political cases if it comes to power.

Law Minister H R Bhardwaj said the Centre has no role in CBI asking Interpol to drop Quattrocchi's name from the wanted list. The agency took the decision on the basis of the opinion given by Attorney General Milon Banerjee given in October last year.Under fire, the CBI came out with a brief statement. Its spokesman Harsh Bahal said, "the case has been under trial in the courts since 1999".CBI has taken action on the basis of legal advice of the highest order.

The CBI had sent the case to Banerjee for seeking his legal opinion in the matter as the five-year validity of Red Corner Notice against 71-year-old Quattrocchi, issued at the behest of the agency, was ending in January this year.

The Attorney General cited CBI's inability to seek Quattrocchi's extradition on two occasions, first in Malaysia in 2003 and then in Argentina in 2007 and opined that the judgements in both the cases indicated that there were no good grounds for extradition hence the warrant cannot remain in force forever. Therefore, the warrant of February 1997 lost its validity, particularly in view of successive failed attempts of the CBI to get the accused extradited from Malaysia and recently from Argentina," Banerjee, the country's top law officer, said.

The Attorney General also cited the May 2005 judgement of Delhi High Court of Justice R S Sodhi who quashed the charges against Hinduja brothers and Bofors Company. The High Court order came after Additional Solictor General B Dutta had conceded that the CBI could not get authenticated or original Swiss documents for proceeding with the case.

Advani said, "this is a very serious issue. It is not a question of Quattrocchi alone but the entire role of the agency during the last five years which should be probed."Describing BJP's allegation as politically motivated, Congress spokesman Abhishek Singhvi said Bofors is a "dead horse" which the opposition party has been trying to flog for several elections.

Amidst the opposition clamour, former CBI director Joginder Singh claimed that the agency had documents which showed that Quattrocchi had allegedly received 7.32 million USD as kickbacks in the Rs.64 crore Bofors scam.
As per official media reports QQ after figuring in category of people wanted by Interpol for 12 years, the CBI has asked the international agency to take off Italian businessman Ottavio Quattrocchi, an accused in the Rs 64 crore Bofors payoff scam, from the Red Corner notice list in which he had been put at India's behest.CBI also took Quattrocchi's off its website, a historical case which changed the destiny of Congress emerging from the major player to moderate national party in India.Prime Minister Rajiv Gandhi friends and others were accused of receiving kickbacks from Bofors AB for winning a bid to supply India's 155 mm field howitzer. Quantum of its influence not only of the corruption which is rampant in India but standards that set nosedived and people who had unflinching support ot heir dear Rajiv reached low ebb and voters did not thereafter believed their leaders in such high spirit that of Rajiv and directly led to the defeat of Gandhi's ruling Indian National Congress party in the November 1989 general elections and since then it has not crossed its seats in parliament from more than 220.Bofors scandal was worth Rs 150 billion (Rs. 150 Arabs). The case came to light during Vishwanath Pratap Singh's tenure as defence minister, and was revealed through investigative journalism by Chitra Subramaniam and N. Ram of the newspapers the Indian Express and The Hindu. The name of the middleman associated with the scandal was Ottavio Quattrocchi, an Italian businessman who represented the petrochemicals firm Snamprogetti.
Quattrocchi was close to the family of Prime Minister Rajiv Gandhi and emerged as a powerful broker in the '80s between big business and the Indian government.

QQ is given clean chit by CBI on Bofors scandal ,the CBI Director took the decision after meeting Union Law Ministeer Hansraj Bharadwaj. The decision was reportedly taken on the advice of the AG after getting
the legal opinion from Attorney General Milon Banerjee.

"The case has been under trial in the courts since 1999. CBI has taken action on the basis of legal advice of the highest order. We will inform the competent court on the next date of hearing (April 30, 2009)," CBI spokesman Harsh Bahal said here today. PTI
February 5,2004 the Delhi High Court quashed the charges of bribery against Rajiv Gandhi and others, but the case is still being tried on charges of cheating, causing wrongful loss to the Government, etc. Win Chadha also died.

On May 31, 2005, the High court of Delhi dismissed the Bofors case allegations against the British business brothers, Shrichand,Gopichand and Prakash Hinduja. In December 2005, the Mr B. Datta, the additional solicitor general of India, acting on behalf of the Indian Government and the CBI,requested the British Government that two British bank accounts of Ottavio Quattrocchi be de-frozen on the grounds of insufficient evidence to link these accounts to the Bofors payoff. The two accounts, containing € 3 million and $1 million, had been frozen in 2003 by a high court order by request of the Indian government (when the (now) opposition party BJP was in power). On January 16, the Indian Supreme Court directed the Indian government to ensure that Ottavio Quattrocchi did not withdraw money from the two bank accounts
    in London.

There is no flexibility or elasticity from our part (in this regard)," Patnaik said. • G20 summit kick One trilion$

On streets of London violent clashes are timed to coincide with the G20 economic summit in London, repeatedly clashing with police in the narrow streets of London’s financial quarter on what protesters designated “Financial Fools Day”.Demonstrators held banners and flags in a good natured and boisterous protest near the ExCel Centre where leaders from top industrialised and emerging economies were meeting to agree on a response to the world’s worst financial crisis since the 1930s.Protesters chanted, No more war, against the wars in Iraq and Afghanistan, conflict in Ethiopia and the greed blamed by many for the economic crisis.
“Abolish all nukes, yes we can,” said one banner. “We won’t pay for their crisis”, read another.Security for the gathering of world leaders, who included U.S. President Barrack Obama, was intense. Many roads near the conference centre were closed and police launches patrolled nearby waterways. Weheras the Indian Prime minister Dr Manmohan Singh partly blamed International Monetary Fund for the current global economic crisis.Briefing the press at G20 leaders’ summit in London he said the G20 declaration will fulfil the aspirations of the developing nations. World leaders on Thursday agreed to pledge $1 trillion more to the International Monetary Fund and other institutions to tide over the worst financial crises in six decades, bringing with it the promise of a greater role for emerging economies like India in the running of the global financial system.

The leaders also agreed to negotiate a speedy conclusion of the Doha trade round and put some $250 billion more for trade finance, both of which were key demands from India, represented by Prime Minister Manmohan Singh.

“We have reached some big, important conclusions,” British Prime Minister and the chair of the G20 summit Gordon Brown said after the leaders concluded their in-camera talks at the ExCel Centre in east London on the bank of Thames, away from the glare of protesters.
Out of $1 trillion pledged for various institutions, $250 billion will be given to the IMF to lend at cheaper rates to needy countries in the form of special drawing rights
British prime minister said with the decisions reached Thursday, some $5 trillion will be spent by the member countries of G20, that account for nearly 85 percent of the global output and two-thirds of the population.

The G20 leaders also agreed to bring an end to tax havens’ jurisdictions that allow people to park their funds hiding behind strict banking secrecy laws, as also those that have extremely loose regulation for the financial sector.

“Banking secrecy must come to an end,” Brown said at the press conference, adding the G20 leaders have committed themselves to ensuring such countries and jurisdictions are not allowed to carry on with the old models.

Besides India, Britain and the US, the G20 comprises Argentina, Australia, Brazil, Canada, China, France, Germany, Indonesia, Italy, Japan, Mexico, Russia, Saudi Arabia, South Africa, South Korea, Turkey and the EU. Dr. Singh noted that the downturn was much deeper than they had thought at last November’s Washington summit, calling for stronger concerted action.

The restoration of the banking system in the industrial countries was a precondition for successful revival. Active contra-cyclical policy must be a priority item and the International Monetary Fund had estimated that a discretionary fiscal stimulus of 2 per cent of the GDP would be needed in 2009 and again in 2010. While the actual stimulus of the G20 countries in 2009 met the Fund target, the amounts planned for 2010 might be too little.

Touching on the situation in India, he noted that the growth rate will fall from close to 9 percent in the last five years to below 7 percent in 2008-09 and to a similar figure in 2009-10.

India had made aggressive use of monetary and fiscal policies, and the total fiscal stimulus would be almost 4 percent of the GDP. The country had gained a great deal from effective regulation of the banking system.

While the current account deficit would rise to 1.4 per cent of the GDP, the country would be able to finance this without difficulty and in any case it could draw on the foreign exchange reserves.

Dr. Singh called for a $500 billion increase in the resources available with the IMF over the next two years as an interim measure pending review of the quotas.

The next review of the quotas due in 2013 needed to be advanced and the quotas at least doubled. They also needed to agree on a fresh allocation of Special Drawing Rights (SDRs) of $250 billion, which would provide developing countries with about $80 billion of usable resources.

The Prime Minister called for a stronger regulation and improved supervision of the financial system if they were to prevent a repeat of the crisis.

The perimeter of regulation needed to be expanded to cover the non-banking sector, steps to redefine capital requirements, to avoid a build up of excessive leverage and to subject systemically important institutions to supervision by a college of supervisors. “We should also endorse sharing information and bringing tax havens and non-cooperative jurisdictions under closer scrutiny,” he said.
